Terms of Use
The practical details of using Memento, caring for your memories and managing purchases.
1. Agreement and provider
Memento is provided by CHAORAN KANG. These terms cover the app, website and related support. By using Memento, you agree to these terms; if you do not agree, stop using it. You must have the legal capacity to agree, or the permission of a parent or guardian where required. Contact: kcr0976@gmail.com.
2. License and permitted use
You receive a limited, personal, non-exclusive license to use Memento lawfully, subject to these terms and the applicable app-store rules. For the iOS app, Apple’s Standard Licensed Application End User License Agreement applies. These terms supplement that agreement and do not replace or restrict its mandatory provisions or your statutory rights.
Do not use Memento to infringe others’ rights, distribute unlawful content, bypass purchase restrictions or interfere with security. Copying, redistribution and reverse engineering are prohibited except where applicable law or an open-source license permits them.
3. Your content and backups
Your memories remain yours. You are responsible for having the rights and permissions to store the photos, recordings and other content you add, including any required consent from people you record. We do not acquire ownership of your memories.
Memento is a personal record-keeping tool. Keep backups appropriate to the value of your content and verify them before relying on them. Backups are not automatic synchronization. Restoring a backup replaces the current library, so create a separate backup first if you wish to retain it. Protect backup files because they have no additional password protection.
Deleting the app, losing a device or replacing a library can cause data loss. We do not host your local library and cannot recover an unbacked-up copy. Dates and time displays are for personal reference, not a guarantee of reminders or time-critical delivery. Example memories and promotional images are illustrative.
4. Free use and Memento Pro
The free plan currently allows up to 10 personal moments. Built-in examples do not count. Memento Pro permits additional moments and is offered through the in-app purchase options available on your platform. The current iOS options are monthly, yearly and a one-time lifetime purchase; the store purchase sheet determines the actual price, currency, taxes, billing period and any offer.
If Pro expires, existing memories remain available to read, edit, delete and back up. Adding new moments above the free limit requires an active Pro entitlement. A lifetime purchase is a one-time purchase of the offered Pro entitlement for the supported life of Memento, not a promise that the app or third-party services will operate forever or that all future separate products are included.
5. Billing, cancellation and restoration
Monthly and yearly subscriptions renew automatically unless canceled through your Apple Account before renewal. Your store account is charged under the terms shown at confirmation. Cancel at least 24 hours before the end of a free trial, if one is offered. Cancellation generally takes effect at the end of the paid period; deleting Memento does not cancel a subscription.
Apple handles iOS billing, subscription management and refund requests under its rules and applicable consumer law. A one-time purchase does not renew. Use Restore Purchases with the same Apple Account and an internet connection to restore an eligible entitlement. We do not promise transfer of purchases between different stores or accounts. RevenueCat helps validate purchase status.
6. Third-party services and availability
Optional iCloud and WebDAV backups, Apple purchases, RevenueCat and website hosting depend on third-party services. Their own terms and privacy policies also apply. Their availability, storage limits and operation can change.
We may update Memento to improve it, maintain compatibility or address security and legal requirements. Features can vary by platform and version. We will respect applicable notice, refund and consumer-protection obligations when making material changes. You may stop using the app at any time.
7. Ownership and responsibility
Memento’s code, branding and design belong to the developer or their licensors, subject to applicable third-party licenses. You retain ownership of your content.
To the extent permitted by law, Memento is provided as available without a promise of uninterrupted or error-free operation. We are not liable for indirect or consequential losses to the extent such a limitation is lawful. Nothing in these terms excludes liability that cannot legally be excluded, including applicable liability for fraud, willful misconduct or negligence, or removes mandatory consumer guarantees and remedies.
8. Changes, applicable law and contact
We may revise these terms as Memento develops. The effective date shows the current version, and material changes will be communicated as required by law. Continued use after changes take effect signifies acceptance only where legally permitted.
Applicable law and courts with lawful jurisdiction govern disputes. These terms do not deprive you of mandatory protections available in your place of residence. Questions about these terms can be sent to CHAORAN KANG at kcr0976@gmail.com.
